2.SUBJECT OF THE CONTRACT
The subject matter of this Agreement belongs to the seller of the buyer www.thealors.com it is the determination of the rights and obligations under the provisions of the sales, delivery and Consumer Protection Law No. 6502 dated 7/11/2013 and distance Contracts Regulation No. 29188 dated 27/11/2014. -
Belonging to the seller subject of this agreement www.thealors.com site in electronic format via the internet and details the order specified below is given related to sales, delivery, and with the law on the protection of consumers in distance contracts is the determination of rights and obligations under the provisions regulations.

3.1. The type, quantity, basic features, brand, model and color of the products are as stated above, and this information is selected and approved by the BUYER.
3.2. The shipping fee for the related products is paid by the SELLER.
3.3. The payment method chosen by the BUYER, the delivery address and the price of the products received are as follows and this information has been confirmed by the BUYER.

4.GENERAL CONDITIONS
4.1. In this contract, the BUYER declares that she/he has read the preliminary information about the basic characteristics, sales price and payment method and delivery of the product subject to the contract, which she/he has purchased from the www.thealors.com website, that she/he is informed and has given the necessary confirmation electronically.
4.2. As explained in the preliminary information form on the website, the products that are the subject of the contract are delivered to the BUYER or the person/organization at the address indicated within 2 to 7 days, depending on the distance of the BUYER's place of residence. If the product is not in stock, the products made on order are delivered to the BUYER or the person/organization at the address indicated within 4 to 14 days. However, the SELLER is not responsible for late deliveries due to the problems that the cargo company may encounter during the delivery process of the products to the buyer.
4.3. If the product subject to the contract is to be delivered to a person/organization other than the BUYER, the SELLER cannot be held responsible if the person/organization to be delivered does not accept the delivery.
4.4. The SELLER is responsible for the delivery of the contractual product in a sound, complete, in accordance with the qualifications specified in the order.
4.5. For the delivery of the contractual product, a copy of this contract must be delivered to the SELLER and the price must be paid in the form of payment preferred by the BUYER. If, for any reason, the product price is not paid or is canceled in the bank records, the SELLER is deemed to be free from the obligation to deliver the product.
4.6. If the bank or financial institution does not pay the cost of the product to the seller due to the unfair or unlawful use of the credit card belonging to the BUYER by unauthorized persons after the delivery of the product, the product must be sent to the seller within 3 days, provided that the buyer has been delivered to him. In this case, the shipping costs belong to the buyer.
4.7. If the SELLER cannot deliver the product within the contract period due to force majeure, weather conditions preventing transportation or extraordinary circumstances such as interruption of transportation, the SELLER has to notify the BUYER. In this case, the BUYER may request the cancellation of the order, the replacement of the product subject to the contract with its precedent, if any, and/or the postponement of the delivery period until the obstacle is removed. In case the BUYER cancels the order, the amount paid is paid to him in full within 10 days.
4.8. In the event that the delivery of the products becomes impossible, the SELLER is obliged to notify the BUYER before the expiry of the performance obligation mentioned in the contract. It is also obliged to return the total price to the BUYER within 10 (ten) days.
5.COURT IN CHARGE
In the implementation of this contract, within the monetary limits set by T.C. Sanayi ve Ticaret Bakanlığı in December each year, Tüketici Sorunları Hakem Heyeti in Istanbul or the Consumer Court that is in BUYER's settlement is authorized.

2.SÖZLEŞMENİN KONUSU
Bu sözleşmenin konusu, alıcı www.thealors.com satıcısına ait olup, 7/11/2013 tarihli 6502 sayılı ve 27/11/2014 tarihli 29188 sayılı Sözleşmeler Yönetmeliği Tüketicinin Korunması Hakkındaki Kanunu ve Mesafeli Satış, Teslimat ve Tüketicinin Korunması Kanunu hükümleri çerçevesinde hak ve yükümlülüklerin tespitidir.
Sözleşme konusu satıcıya ait olan www.thealors.com sitesinde internet üzerinden elektronik formatta ve detaylı olarak aşağıda belirtilen siparişlere ilişkin satış, teslimat ve mesafeli sözleşmesindeki düzenlemeler kapsamındaki hak ve yükümlülüklerin Tüketicinin Korunması Kanunu ile Tüketicinin Korunması Hakkında Kanun hükümleri altında tespitidir.

3.1. Ürünlerin cinsi, miktarı, temel özellikleri, markası, modeli ve rengi yukarıda belirtildiği gibi olup, bu bilgiler ALICI tarafından seçilerek onaylanmıştır.
3.2. İlgili ürünlerde kargo ücreti SATICI tarafından karşılanır.
3.3. Alıcı tarafından seçilen ödeme şekli, teslim adresi ve teslim alınan ürünlerin fiyatı aşağıdaki gibidir ve bu bilgiler ALICI tarafından teyit edilmiştir.

4.GENEL KOŞULLAR
4.1. ALICI, sözleşmede www.thealors.com internet sitesinden satın almış olduğu sözleşme konusu ürünün temel nitelikleri, satış fiyatı ve ödeme şekli ile teslimatı ile ilgili ön bilgileri okuduğunu beyan eder. Elektronik ortamda bilgilendirildiğini ve gerekli teyidi verdiğini beyan eder.
4.2. Web sitesinde yer alan ön bilgi formunda açıklandığı üzere, sözleşme konusu ürünler ALICI'nın ikametgahının uzaklığına bağlı olarak 2 ila 7 gün içinde ALICI'ya veya gösterdiği adresteki kişi/kuruluşa teslim edilir. Ürün stokta yoksa, sipariş üzerine yapılan ürünler 4 ila 14 gün içinde ALICI'ya veya gösterdiği adresteki kişi/kuruluşa teslim edilir. Ancak ürünlerin alıcıya teslimi sürecinde kargo firmasının karşılaşabileceği sorunlardan dolayı geç teslim edilmesinden SATICI sorumlu değildir.
4.3. Sözleşme konusu ürün, ALICI dışında bir kişi/kuruluşa teslim edilecek ise, teslim edilecek kişi/kuruluşun teslimatı kabul etmemesinden SATICI sorumlu tutulamaz.
4.4. SATICI, sözleşme konusu ürünün sağlam, eksiksiz, siparişte belirtilen niteliklere uygun olarak teslim edilmesinden sorumludur.
4.5. Sözleşme konusu ürünün teslimi için sözleşmenin bir nüshasının SATICI'ya teslim edilmesi ve bedelin ALICI'nın tercih ettiği ödeme şekli ile ödenmesi gerekmektedir. Herhangi bir nedenle ürün bedelinin ödenmemesi veya banka kayıtlarında iptal edilmesi durumunda SATICI, ürünü teslim etme yükümlülüğünden kurtulmuş sayılır.
4.6. Ürün tesliminden sonra alıcıya ait kredi kartının yetkisiz kişilerce haksız veya hukuka aykırı kullanımı nedeniyle banka veya finans kuruluşu ürün bedelini satıcıya ödemez ise, ürünün satıcıya 3 gün içinde gönderilmesi gerekir. Bu durumda kargo ücreti alıcıya aittir.
4.7. SATICI, mücbir sebepler, nakliyeyi engelleyen hava koşulları veya nakliyenin kesintiye uğraması gibi olağanüstü haller nedeniyle sözleşme süresi içinde ürünü teslim edemezse, SATICI'nın durumu ALICI'ya bildirmesi gerekir. Bu durumda ALICI siparişin iptal edilmesini, sözleşme konusu ürünün varsa emsali ile değiştirilmesini ve/veya teslimat süresinin engel kaldırılıncaya kadar ertelenmesini talep edebilir. ALICI'nın siparişi iptal etmesi durumunda ödediği tutar 10 gün içinde kendisine eksiksiz olarak ödenir.
4.8. Ürünlerin teslimatının imkansız hale gelmesi durumunda SATICI, sözleşmede belirtilen ifa yükümlülüğünün süresi dolmadan ALICI'yı bilgilendirmekle yükümlüdür. Ayrıca toplam bedeli 10 (on) gün içinde ALICI'ya iade etmekle yükümlüdür.
5.SORUMLU MAHKEME
Bu sözleşmenin uygulanmasında T.C. Sanayi ve Ticaret Bakanlığı her yıl Aralık ayında İstanbul'daki Tüketici Sorunları Hakem Heyeti veya ALICI'nın yerleşim yerindeki Tüketici Mahkemesi yetkilidir.
